Thank you for using Olgara. These Terms of Service ("Terms") explain the rules for using our app and services. By signing up for Olgara, you're agreeing to these terms.

Please read this carefully. The most important things to know:

• Olgara is a tool to help you track and understand your symptoms - it's NOT medical advice

• You're responsible for your own health decisions

• We're currently in beta/pilot phase, so things might change

• Your data is yours, and we protect it (see our Privacy Policy)

If you don't agree with these terms, please don't use Olgara.

What Olgara Is (And Isn't)

What Olgara IS:

• A tool to help you track symptoms, meals, medications, and patterns

• A way to better understand your health through personalized insights

• A companion to help you communicate more effectively with your healthcare providers

• A bilingual (English/Spanish) health tracking platform

What Olgara IS NOT:

• NOT medical advice - We don't diagnose, treat, or cure any medical condition

• NOT a replacement for your doctor - Always consult healthcare professionals for medical decisions

• NOT emergency services - If you're having a medical emergency, call 911 or your local emergency number immediately

• NOT FDA-approved - We're a wellness tracking tool, not a medical device

By using Olgara, you acknowledge that:

• The insights we provide are based on patterns in your self-reported data

• These insights are educational and informational only

• You should never rely solely on Olgara for medical decisions

• You should always consult qualified healthcare professionals

Eligibility

To use Olgara, you must:

• Be at least 18 years old

• Have the legal capacity to enter into this agreement

• Provide accurate information when creating your account

If you're under 18, please don't use Olgara.

Your Account

Creating Your Account:

• You'll sign up using Google authentication (or other methods we provide)

• You're responsible for keeping your login credentials secure

• You're responsible for all activity that happens under your account

• Don't share your account with others

Account Security:

• If you think someone accessed your account without permission, contact us immediately at hello@myolgara.com

• We're not responsible for losses resulting from unauthorized use of your account if you didn't notify us promptly

Accurate Information:

• Provide truthful information about yourself

• Keep your information up to date

• Don't impersonate anyone else

Beta/Pilot Phase

Olgara is currently in beta/pilot phase. This means:

You should expect:

• Bugs and technical issues

• Features that change or get removed

• Occasional downtime or service interruptions

• New features being tested

We're working hard to make Olgara reliable, but during this phase:

• The app is provided "as is"

• We can't guarantee 100% uptime

• Features and pricing may change as we learn and grow

• We deeply appreciate your patience and feedback

If you're participating in our pilot program:

• You may be asked for feedback

• You may get early access to new features

• The terms may be slightly different (we'll let you know)

How to Use Olgara

You Can:

• Track your symptoms, meals, medications, and other health data

• View insights and patterns based on your data

• Export your data at any time

• Use the app in English or Spanish

• Share your data with healthcare providers if you choose

You Can't:

• Use Olgara for any illegal purpose

• Try to hack, disrupt, or interfere with the app

• Copy, modify, or reverse engineer our code

• Scrape or collect data from other users

• Upload viruses, malware, or harmful code

• Violate anyone else's privacy

• Use the app to harass, abuse, or harm others

• Share false or misleading health information intentionally

If you violate these terms, we may suspend or terminate your account.

Your Content & Data

You Own Your Data:

• The symptoms, meals, medications, and other information you log belongs to you

• You can download or delete it anytime

• See our Privacy Policy for how we use and protect your data

License to Us:

• By using Olgara, you grant us permission to use your data to provide our services (generate insights, show patterns, improve the app)

• We may use anonymized, aggregated data for research and to improve Olgara

• This license ends when you delete your account (except for anonymized data)

Your Responsibility:

• You're responsible for the accuracy of information you enter

• Don't upload content that's illegal, harmful, or violates others' rights

• Don't upload others' personal health information without permission

Intellectual Property

We Own Olgara:

• The Olgara app, name, logo, design, code, and AI algorithms are owned by us (or our licensors)

• "Olgara" is a trademark (we have a provisional patent too!)

• You can't use our intellectual property without permission

You Get a License to Use Olgara:

• We grant you a limited, personal, non-exclusive license to use the app

• This license is for your personal health tracking only

• You can't resell, redistribute, or create derivative works

Payments & Subscriptions

Current Pricing:

• Olgara is currently free during our pilot/beta phase

• This may change as we scale

Future Pricing:

• If we introduce paid features or subscriptions, we'll notify you clearly

• You'll have the option to accept new pricing or stop using paid features

• We'll never charge you without your explicit consent

• Any subscriptions can be canceled at any time

Refunds:

• If we ever charge for services, our refund policy will be clearly stated

• Generally, we'll offer refunds for unused portions of paid subscriptions

AI-Generated Insights

How Our AI Works:

• Olgara uses artificial intelligence to analyze patterns in your data

• Our AI identifies correlations (like "bloating after eating bread")

• These insights are based on your self-reported information

Important Limitations:

• AI can make mistakes

• Correlation doesn't equal causation

• Insights are suggestions, not diagnoses

• Always verify important patterns with healthcare professionals

You acknowledge that:

• AI-generated insights may be inaccurate

• We're continuously improving our algorithms

• You use these insights at your own discretion

Third-Party Services

We Use Third-Party Services:

• Firebase (Google) for data storage and authentication

• Other services for app functionality

You understand that:

• These services have their own terms and privacy policies

• We're not responsible for third-party service issues

• You may need to agree to their terms separately

Disclaimers

IMPORTANT - PLEASE READ:

NO MEDICAL ADVICE:

• OLGARA DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT

• ALL CONTENT IS FOR INFORMATIONAL PURPOSES ONLY

• ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN OR QUALIFIED HEALTHCARE PROVIDER

• NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE BECAUSE OF SOMETHING YOU READ IN OLGARA

• IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY

"AS IS" SERVICE:

• Olgara is provided "as is" and "as available"

• We don't guarantee the app will be error-free or uninterrupted

• We don't guarantee the accuracy, reliability, or completeness of any content

• During beta phase, expect bugs and changes

USE AT YOUR OWN RISK:

• You use Olgara at your own risk

• We're not liable for health outcomes based on using (or not using) Olgara

• We're not liable for decisions you make based on insights from the app

Limitation of Liability

To the fullest extent permitted by law:

• We're not liable for any indirect, incidental, special, or consequential damages

• We're not liable for lost profits, data loss, or business interruption

• Our total liability to you is limited to the amount you paid us in the past 12 months (currently $0 during beta)

This applies even if:

• We were advised of the possibility of such damages

• The remedy fails its essential purpose

Some jurisdictions don't allow these limitations, so they may not apply to you.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of Olgara

• Your violation of these Terms

• Your violation of any rights of others

• Content you submit to Olgara

In plain language: If your use of Olgara causes legal problems for us, you're responsible.

Termination

You Can Leave Anytime:

• Delete your account in Settings

• All your data will be permanently deleted (see Privacy Policy)

• Some anonymized data may remain for research

We Can Terminate Your Account If:

• You violate these Terms

• You misuse the app

• We discontinue Olgara

• We have legal or safety concerns

If we terminate your account:

• We'll try to give you notice when possible

• You'll lose access to your data (unless you exported it)

• These Terms still apply to past use

Changes to These Terms

We May Update These Terms:

• As Olgara grows and changes

• To comply with laws

• To clarify existing terms

When we make changes:

• We'll update the "Last Updated" date

• We'll notify you by email or in-app notification for significant changes

• Continued use means you accept the new terms

If you don't agree with changes:

• You can delete your account

• Export your data first if you want to keep it

Dispute Resolution

We Hope It Never Comes to This, But:

First, Let's Talk:

• If you have a problem, contact us at hello@myolgara.com

• We'll do our best to resolve it informally

• Most issues can be worked out this way

If We Can't Resolve It:

• Any disputes will be governed by the laws of Arizona, United States

• You agree to resolve disputes in the courts of Arizona

• You waive any right to a jury trial

• You waive any right to participate in a class action

Exceptions:

• You can always file complaints with relevant government agencies

• You can seek injunctive relief if necessary

General Legal Stuff

Entire Agreement:

• These Terms and our Privacy Policy are the entire agreement between us

• They replace any previous agreements

Severability:

• If any part of these Terms is found invalid, the rest still applies

No Waiver:

• If we don't enforce a term, that doesn't mean we're waiving it

Assignment:

• You can't transfer your rights under these Terms

• We can transfer our rights (like if Olgara gets acquired)

Force Majeure:

• We're not liable for delays or failures due to circumstances beyond our control (natural disasters, pandemics, etc.)

If you're part of our pilot program, thank you for being an early believer in Olgara. Your feedback is helping shape a tool that will help millions of people with chronic illness finally feel understood.

During this beta phase:

• Be patient with bugs and changes

• Share your honest feedback

• Know that we're working constantly to improve

• Your trust and input mean everything

In Plain Language

Here's what this all means:

1. Olgara helps you track health patterns - it's not a doctor

2. Always consult real healthcare professionals for medical decisions

3. We're in beta - expect some bumps along the way

4. Your data is yours - you can delete it anytime

5. We protect your privacy - we never sell your data

7. We're not liable if something goes wrong (but we'll try our best to help)

Most importantly: We built Olgara because the healthcare system failed people with chronic illness. We're here to help, not to replace your doctors. Use Olgara as a tool to better understand your body and communicate with your healthcare team.
